End User License Agreement (EULA) for BillsNBudgets

1. Definitions

1.1 "BillsNBudgets"

Refers to the software product provided by Open Windows Software Pty Ltd (russelldoig.com).

1.2 "User"

Refers to any individual or entity accessing or using the BillsNBudgets software.

2. Acceptance of Agreement

2.1

By accessing or using BillsNBudgets, the User agrees to be bound by the terms and conditions set forth in this End User License Agreement.

3. License

3.1

russelldoig.com grants the User a non-exclusive, non-transferable license to use BillsNBudgets in accordance with the terms and conditions of this Agreement.

4. Fees and Usage

4.1

The User agrees to pay a flat monthly fee for usage of BillsNBudgets, as outlined in the pricing plan provided by russelldoig.com.

4.2

In the event that the User's monthly token usage exceeds five (5) million tokens, the User agrees to pay an additional fee of one (1) cent (in AUD) per one (1) million tokens used beyond the initial five (5) million per month.

5. Reasonable Use Policy

5.1

The User agrees to use BillsNBudgets in a reasonable manner, consistent with its intended purpose. Unreasonable use includes but is not limited to excessive or abusive usage, or usage that violates applicable laws or regulations or what would be considered reasonable by a reasonable person.

6. Privacy and Data Protection

6.1

russelldoig.com adheres to all privacy and data protection rules and regulations applicable in Australia. The User's data and privacy rights are outlined in russelldoig.com's Privacy Policy.

7. Liability

7.1

russelldoig.com shall not be liable for any damages or losses arising from the User's use of BillsNBudgets, including but not limited to:

  • Any harm caused to the User's website or introduction of harmful code as a result of installing or using BillsNBudgets.
  • Any false or misleading information provided by BillsNBudgets, as it generates answers based on the information provided by the user and by the training material.

8. Termination

8.1

russelldoig.com reserves the right to immediately terminate the User's access to BillsNBudgets in the event of unreasonable use or violation of this Agreement.

9. Collection and Aggregation of Data

9.1

russelldoig.com may collect and aggregate data related to the User's usage of BillsNBudgets for the purpose of improving the software and providing better services to Users.

10. Changes to Pricing

10.1

russelldoig.com reserves the right to change the pricing for BillsNBudgets with 30 days’ notice to the User.

11. Miscellaneous

11.1

This Agreement constitutes the entire agreement between the parties concerning the subject matter herein and supersedes all prior agreements and understandings.

11.2

This Agreement shall be governed by and construed in accordance with the laws of Australia.
